| Board/Commission Name | Board of Building Code Appeals |
| Introduction/Overview/Duties | Hears cases where the owner of a building, the owner's agent or any other person, firm or corporation directly involved in the design and/or construction of a building or structure may appeal to the local Building Code Board of Appeals within 90 days from a decision of the building official when it is claimed that: 1) The building official has refused to grant a modification which complies with the intent of the provisions of the USBC, or 2) The true intent of the USBC has been incorrectly interpreted, or 3) The provisions of the USBC do not fully apply, or 4) The use of a form of construction that is equal to or better than that specified in the USBC has been denied. |
| Length of Term | Members serve terms of five years. |
| Frequency/Times for Meetings | Meetings are held whenever appeal applications are received. Times of meetings vary. |
| Membership | The Board of Appeals shall consist of five members appointed by the Board of County Supervisors to serve for five years or until a successor is appointed. Board members shall be selected by the local government on the basis of ability to render fair and competent decisions regarding application of the code, and shall to the extent possible, represent different occupational or professional fields. Employees or officials of the local government appointing the board shall not serve as board members. Members do not have to be residents of Albemarle County. Members are paid $45.00 per meeting, Albemarle Code ยง 2-1105). |
| Qualifications | Each member shall be a licensed professional engineer or architect, or a builder or superintendent of building construction, with at least 10 years experience, for five years of which the member shall have been in responsible charge of work, and at no time shall there be more than two members of the board selected from the same profession or business, and at least one of the professional engineers shall be a licensed structural or civil engineer of architectural engineering experience. |
