BACKGROUND:

On April 8, 2008, the Planning Commission reviewed the request by 5th Street Development for a Special Use Permit to allow fill in the floodplain. The Planning Commission recommended denial by a vote of 4 – 2 (Mr. Morris was absent), based on the County Engineer’s position that placement of the fill was not in harmony with the purpose and intent of the ordinance.

 

DISCUSSION:

Since the Planning Commission meeting, the applicant has been notified by the Federal Emergency Management Agency (FEMA) that the Letter of Map Revision (LOMR) will be reissued. The applicant has requested that staff forward the attached e-mail message to the Board in advance of the Board’s Public Hearing. Lori Wade, who sent the e-mail, works for the company that is under contract to FEMA to prepare the Flood Insurance Rate Maps (FIRMs). Her message indicates that the LOMR will be reissued. (Attachment I)  While this new material provides a more current status, it does not address the Commission’s reason for recommending denial.

 

RECOMMENDATION:

The Planning Commission recommends denial of this Special Use Permit.
