What Plan and Proffers Provide

Route 29 Improvements – Gap is southbound lane improvements for undefined period of time

Build Southern entrance improvements first, build remaining improvements within five years (Dennis pointing to Option 2 stuck in my mind.) 

Build southern entrance first, build or bond remaining improvements for middle entrance after reach 290,000 SF of commercial space.  (Note: Staff believes Board asked for 5 year commitment, applicant believes that was not a concern provided the southern entrance improvements were built first. )

Leake / Proffit Intersection Improvements – No commitment to actually build improvements

Assure roundabout will be constructed with initial improvements

Proffer provides mechanism for County to condemn and be reimbursed by North Pointe if additional right of way required.  With this provision, it appears the issue has been addressed the Board’s interest. 

Proffit Road– No commitment to actually build improvements

Build eastbound and westbound lane between Leake Road and Route 29

Proffer provides mechanism for County to condemn and be reimbursed by North Pointe if additional right of way required.  With this provision, it appears the issue has been addressed the Board’s interest. 

25’ Landscape Buffer, onsite and outside of parking areas

Assure buffer is provided

Proffer provides a minimum of 40 foot buffer, but may require removal of parking spaces  With this provision, it appears the issue has been addressed the Board’s interest. 

Maximum size footprint of 88,500 SF for one building, others limited to 72,000

Board did not raise concerns with expansion of10% beyond 88,500 SF, other building sizes not addressed

Allows Building 14 to be expanded to 97,350 with expansion against North Pointe Blvd Allows Building 6 to expand beyond 72,000 SF to 79,200 SF.  With this provision, it appears the issue has been addressed the Board’s interest. 

Transportation proffer complexity – Hard to enforce

Southbound 29 simplification discussed above, not addressed on other parts

Proffers simplified by commitment to complete southern entrance first.  This appears to satisfy the Board’s interest. 

Affordable housing, provide 15% per established policy

Board heard North Pointe offer additional 20 rental units, interest focused on appropriate cash contribution to compensate for the difference in units provided versus 15%. 

North Pointe is providing 40 for-sale units and 66 for-rent units, while paying $300,000 within 60 days of rezoning.  Ron White believes this addressed the Board’s interest in assuring the applicant provided the equivalent to 15% affordable housing units.  .    

Phasing Special Use Permit Condition – Assure housing is provided in timely manner

Assurance that housing alternatives to Rural Area are being provided.  No specifics offered.  

Staff and North Pointe have agreed upon a commitment to obtain building permits for at least 40 single family detached houses per year until a minimum of 200 single family residential units have been issued, starting with the first commercial C.O.
