Weather Hill Development is the property owner; Weather Hill Development, with Terra Concepts, P.C. as the consulting engineer, is also the applicant.

 

BACKGROUND:

On June 6, 2006, the Planning Commission held a public hearing on the rezoning request and the critical slopes waiver. The Commission unanimously recommended approval with the following changes:

 

        The final application plan will reflect a pedestrian path in the location discussed during the Planning Commission work session and shown on a revised plan at the June 6, 2006 Planning Commission meeting.

        Approval of the proffers as to form by the County Attorney.

        The affordable housing proffer will state that the cash proffer is initiated at the beginning of construction of every seventh unit.  

 

The Commission approved the critical slopes waiver.

 

During the Planning Commission meeting on June 6th, there was discussion on whether the development itself made providing affordable housing cost prohibitive, as indicated by the applicant. The Planning Commission did not agree that providing affordable housing would be cost prohibitive, but they did agree that a cash proffer towards affordable housing programs was acceptable given the few number of units provided.

 

DISCUSSION:

The revised plan shows a pedestrian path in the location discussed at the Planning Commission public hearing on June 6th. The proffers have been reviewed and the requested change to the affordable housing proffer has been completed. The proffers have also been revised per the recommendations of the County Attorney. Attachment A contains the proffers dated June 22, 2006. Attachment B contains the General Development Plan dated August 29, 2005, and revised June 6, 2006.

Since the public hearing, the applicant requested that staff provide an updated fiscal impact analysis which is included as Attachment C. The updated fiscal impact analysis indicates a positive return to the County.

 

RECOMMENDATIONS:

Staff recommends approval.
