BACKGROUND:
Virginia Code § 27-36 provides that the Board may appoint one or more assistant fire marshals, who, in the absence of the Fire Marshal, shall have the powers and perform the duties of the fire marshal. In addition, Virginia Code § 27-34.2:1 provides that in addition to such other duties as may be prescribed by law, the governing body may authorize an assistant fire marshal to have the same police powers as a sheriff, police officer or other law enforcement officer and the authority to investigate and prosecute certain designated offenses.

DISCUSSION:
The appointment of Gary Rodney Snead, who is currently a Fire Prevention Inspector/Investigator, as an Assistant Fire Marshal is necessary in order for him to fulfill the duties and responsibilities of the Fire Marshal’s office. He has satisfactorily completed the mandated training designed by the Virginia State Department of Fire Programs and approved by the Virginia Fire Services Board for fire marshals that is a prerequisite for a fire marshal to exercise police powers pursuant to Virginia Code § 27-34.2:1. The Board has previously authorized assistant fire marshals to exercise police powers.
BUDGET IMPACT:
This action will have no impact on the County budget.
Staff recommends that the Board adopt the attached Resolution appointing Gary Rodney Snead as an Assistant Fire Marshal with full police powers as authorized in Virginia Code §§ 27-34.2:1 and 27-36.
