RESOLUTION OF INTENT
WHEREAS, the Rural Areas Plan (the “Plan”) was adopted by the Board of Supervisors as part of the Albemarle County Comprehensive Plan on March 2, 2005, and one of the stated objectives of the Plan is to minimize the amount of land used for residential development in the Rural Areas in order to maximize the amount of land available for agriculture, open space, and natural, scenic and historic resources;
WHEREAS, one of the strategies identified in the Plan to minimize the amount of land used for residential development is to require Rural Preservation Development (clustering) for all Rural Areas subdivisions, with certain exceptions;
WHEREAS, such a clustering program would maintain the currently allowed density but would require the development to occur in a more compact form, and simultaneously allow a substantial portion of the land to be retained for agriculture, open space, and natural, scenic and historic resources; and
WHEREAS, it is desired to amend the Albemarle County Zoning Ordinance to establish a clustering program as described herein on lands within the Rural Areas zoning district (Albemarle County Code § 18-10).
NOW, THEREFORE, BE IT RESOLVED THAT for purposes of public necessity, convenience, general welfare and good zoning practices, the Board of Supervisors hereby adopts a resolution of intent to amend Albemarle County Code § 18-10 and any other regulations of the Zoning Ordinance deemed appropriate to achieve the purposes described herein.
BE IT FURTHER RESOLVED THAT the Planning Commission shall hold a public hearing on the zoning text amendment proposed by this resolution of intent, and make its recommendation to the Board of Supervisors, at the earliest possible date.
