County Business and Tax Law Changes

As tax season approaches, the Albemarle County Finance Department wants to alert business owners to certain County license and tax law changes, adopted by the Board of Supervisors following a public hearing in July, 2016. These changes went into effect on January 1, 2017, and will apply to the business filings due in early 2017. Businesses that file their license applications and property tax returns by the respective due dates are unlikely to be affected by many of these changes.

8-402 License Fee
Due Date
Businesses assessed the flat license fee are now required to pay that fee with their business license application. That is, for any license not based on gross receipts, payment of the flat license fee is due at the time of application. Businesses with gross receipts greater than $5,000 but less than $100,000 must submit a flat license fee of $50 along with their application by March 1. Businesses with gross receipts of at least $100,000 that are subject to a rate-based license tax must pay by June 15. Tax rates and fee schedules for the different types of businesses are available at www.albemarle.org/Finance.

Failure to File
Businesses with gross receipts greater than $5,000 but less than $100,000 must submit a flat license fee of $50 along with their application by March 1. Businesses with gross receipts of at least $100,000 that are subject to a rate-based license tax must pay by June 15. Tax rates and fee schedules for the different types of businesses are available at www.albemarle.org/Finance.
 
Businesses that fail to file license renewal applications by March 1 will incur a late filing penalty of 10% of the balance due. For example, if a $100 license tax is due on June 15, a business waiting until June 15 to both file and pay will be assessed a $10 late filing fee.  However, only a single 10% penalty is imposed on businesses who fail to both timely file and pay.

Threshold for out-of-County Contractors 
Out-of-County contractors that generate at least $25,000 in Albemarle-based gross receipts must file a license application and pay a $50 fee. That is, the minimum threshold of Albemarle-based gross receipts for these contractors has been reduced from $100,000 to $25,000. Out-of-County contractors with $25,000-$100,000 of Albemarle-based gross receipts are now subject to Albemarle licensure.  Out-of-county contractors that earn at least $25,000, but less than $100,000 in gross receipts from work performed in Albemarle County will be required to obtain an Albemarle business license and pay a flat $50 license fee.

Personal Property Penalty
Businesses must file business personal property returns by May 1. A 10% penalty will be imposed on a failure to timely file a business personal property return.  Businesses owning property in the County that file their business personal property (BPP) returns after May 1 will be assessed a 10% late filing penalty. Businesses that fail to file a BPP return by May 1, and also fail to pay BPP taxes by June 5th will be assessed both a late filing fee and a late payment fee on their BPP account.
